Privacy Policy & Terms of Service
Terms of Service
1. About These Terms
These Terms of Service (“Terms”) govern your use of the mobile applications and related services that link to these Terms (the “Services”), provided by Hellotoon, Inc (“Hellotoon,” “we,” “us,” or “our”), a company established in the Republic of Korea.
Please review these Terms before accepting them. We make them available for you to save and explain important conditions before you enter into a contract. If you do not agree, do not complete the acceptance process or begin using features that require an agreement.
Some Services are available without an account. Provisions concerning accounts, purchases, subscriptions, or public sharing apply only where the relevant feature is offered. Feature-specific terms will be presented before you use the feature. Individually agreed terms prevail to the extent permitted by law. Nothing in these Terms limits mandatory consumer rights.
2. Eligibility and Accounts
You must meet the age and eligibility requirements disclosed for the relevant application. Where a minor needs the consent of a parent or legal guardian to enter into an agreement or make a purchase, that consent must be obtained. We will provide legally required consent procedures. Rights to cancel unauthorized purchases by minors are described in Section 7.
Where we are required to obtain a parent’s or guardian’s consent to process a child’s personal information, the relevant feature will not be available to the child unless the required consent and verification procedure has been completed.
If an account is required, provide accurate information and take reasonable care to protect your credentials. Do not impersonate another person, use their account without authorization, or sell or transfer your account unless we expressly permit it. Notify us promptly if you discover unauthorized access or charges.
For guest or device-only use, we will explain relevant storage and recovery limitations. Deleting an application, clearing its storage, or changing devices may remove locally stored data. Available account linking, backup, or purchase restoration options will be described in the Services. These limitations do not exclude liability for problems attributable to us.
3. Permission to Use the Services
Subject to these Terms and any disclosed product conditions, we grant you a limited, non-exclusive right to install and use the Services for their intended purposes. The application, our designs, and our supplied materials remain owned by us or their respective rights holders.
Your use of an application does not transfer ownership of its software or supplied assets. If a Service allows you to create, export, or share work, the rights to use our templates, images, fonts, or other assets in that work are governed by the license shown for those assets or that feature. We will disclose material restrictions before acquisition or use. Your rights in your own original material remain yours. Uses permitted by law are not restricted.
4. Acceptable Use
You must not:
- Use the Services for unlawful activity, fraud, threats, harassment, sexual exploitation, or infringement of another person’s rights;
- Collect or disclose another person’s personal information without lawful authority;
- Upload malicious code, attack the Services, circumvent security for an improper purpose, or interfere with other users’ access;
- Exploit errors, manipulate purchases or refunds, or use unauthorized automation to disrupt the Services or obtain an unfair advantage;
- Impersonate Hellotoon or distribute unauthorized spam through the Services; or
- Copy, distribute, modify, or reverse engineer the software without permission, except where applicable law permits it.
We will not restrict legitimate criticism or the lawful exercise of consumer rights. Enforcement will reflect the nature, severity, repetition, and impact of the conduct.
5. Service Availability and Changes
We disclose relevant device, operating system, network, and compatibility requirements. Your carrier or internet provider may charge for data use under your agreement with that provider.
We use reasonable care to maintain the Services and address failures. Planned maintenance will be announced in advance where practicable. Urgent security work or unforeseen outages may require immediate action; we will provide an explanation as soon as reasonably possible.
We may make reasonable changes for security, compatibility, technical improvements, or changes in how the Services operate. We will ordinarily give at least 30 days’ notice of changes that materially affect your use. Urgent security or error corrections may be implemented sooner.
We will not unjustifiably remove essential features or reduce a usage period promised when you purchased a product. If a change materially disadvantages an existing paid entitlement, we will obtain any required consent or offer an appropriate remedy, including a refund for the unused portion where applicable.
If we discontinue a Service, we will give at least 30 days’ notice, including the end date, refund arrangements, and any available means of retrieving your data. If circumstances beyond our reasonable control make advance notice objectively impossible, we will notify you without delay. Remaining paid entitlements and any liability for interruption or discontinuation will be handled under Sections 7 and 13 and applicable law.
6. Purchases and Subscriptions
Before you purchase a paid feature, digital content, access period, or subscription, we explain its principal features, total price, duration, delivery, material limitations, and cancellation and refund conditions. The purchase grants the rights described in that offer; it does not transfer copyright unless expressly stated.
Payments may be processed by an app marketplace or payment provider. Their payment procedures apply, but do not override your mandatory rights or our legal obligations. Foreign-currency charges may differ because of the payment provider’s exchange rates or fees. Fees charged by us will be disclosed before payment.
Where subscriptions are offered, the purchase screen explains the billing cycle, automatic renewal, trial terms, conversion to paid billing, and how and when to cancel to prevent the next charge. You can stop future renewal using the subscription management method identified in the application or the relevant marketplace. We will not make cancellation unreasonably difficult.
Stopping renewal is separate from requesting early termination or a refund for an already paid period. Applicable refund rights remain available under Section 7.
Before increasing a recurring charge or converting a free offer into a paid recurring subscription, we will give the notices and obtain the express consent required by applicable law. We will not charge an increased or newly payable amount without required consent.
Deleting an application or account does not necessarily cancel a subscription managed by an app marketplace. We will explain the applicable cancellation process and provide access to subscription management where relevant.
7. Withdrawal, Cancellation, and Refunds
For purchases covered by Korean consumer law, you may generally withdraw within seven days after receiving the contract information in writing or electronically. If supply begins later, the period starts when the digital content is supplied or its supply begins. Other statutory periods, including those concerning missing contract information or obstruction of withdrawal, remain available.
Withdrawal from digital content may be restricted only where the law permits it, including where supply has begun and we have completed the required disclosures and trial or other legally permitted information measures. Separable portions that have not begun to be supplied remain subject to applicable withdrawal rights. Immediate activation or use of a promotional benefit does not automatically eliminate all rights concerning the entire purchase.
If content differs from its description or advertising, or the contract is not performed as agreed, Korean law provides for withdrawal within three months after supply and within 30 days after you knew or could have known of the discrepancy. More protective mandatory local rights remain unaffected.
You may contact us through the support details in Section 18 or use the relevant marketplace’s process. A written withdrawal takes effect when it is sent. We may request proportionate information to identify the transaction, without shifting our statutory burden of proof to you.
For a valid statutory withdrawal from digital content under Korean law, we refund payment within three business days after withdrawal, promptly request any necessary cancellation from the payment provider, and fulfill applicable refund obligations. Statutory compensation for delay applies where required. No penalty is charged merely for exercising a statutory right of withdrawal.
For other early termination or service discontinuation, we calculate refunds using the actual purchase price and unused period or unused paid portion, subject to applicable law and valid purchase conditions. Any permitted deduction must have a lawful basis and be explained. We will not retrospectively apply an arbitrary list price to reduce a refund. No termination fee applies where termination is attributable to us.
An independently provided free benefit ordinarily has no cash refund value. Benefits forming part of a paid offer will not be excluded merely because they are labeled “free.” Overpayments will be refunded promptly after verification.
A minor or their legal representative may cancel a purchase made without legally required consent, subject to statutory exceptions. We will not presume consent solely from ownership of the device or payment method and will request only necessary verification information.
Marketplace procedures and internal request periods do not extinguish statutory rights. We cooperate with payment providers and remain responsible for our own legal duties.
8. Your Content
This Section applies if a Service allows you to upload, submit, or share material. You retain your rights in your original content and must have the rights needed to submit it and use the selected sharing features.
When you submit content to us, you grant us a non-exclusive, royalty-free license to store, reproduce, transmit, display, and technically format it only as necessary to provide and operate the requested Services, consistently with your visibility settings. The license is limited to where the Services operate and the period needed to provide the content through the Services. Providers acting for us may process it only within that purpose and scope.
We do not receive a general license to sell your content, use it in external advertising, or train AI models on it. Such uses require separate permission or another lawful authority and any necessary privacy disclosures.
You may request deletion through available controls or support. The operational license ends when the content is deleted or your account is closed. Legally necessary records and restricted backups may remain only for the purposes and periods described in our Privacy Policy, without new public exploitation. We will explain any limitations concerning lawful copies already shared with others or copies outside our control.
We may remove or restrict unlawful or infringing content under Section 12. You may report infringement or appeal a decision through support.
9. Privacy and Device Permissions
Our Privacy Policy explains how personal information is processed and how to exercise privacy rights.
Accepting these Terms is not blanket consent to optional data collection, personalized advertising, international transfers, or other processing requiring separate consent. Where required, we provide specific notices and choices before processing.
Device permissions are requested for the functions that need them. You can manage permissions in device settings, although a function dependent on a permission may then be unavailable. Optional choices will not prevent use of unrelated basic features.
10. Advertising and Third-Party Services
Our Services include advertising. Applicable data practices and controls are described in our Privacy Policy. Reward conditions, where offered, will be stated before you view a rewarded advertisement.
We send promotional communications only where legally permitted and obtain consent where required. You can opt out through the message or the relevant settings. Necessary transaction, security, and account notices are distinct from promotional messages.
External sign-in, payment, storage, or linked services may have their own terms and privacy notices. We do not guarantee every action of an independent provider, but remain responsible for our own conduct and obligations, including those concerning providers processing data on our behalf.
11. Account Closure and Data Deletion
You may stop using the Services at any time. If an account is offered, you may initiate account deletion using the in-app route disclosed for the Service. You can also contact support for assistance. Our Privacy Policy describes the applicable deletion route and how to request deletion without access to the application.
Before closure, we explain relevant effects on saved data, purchases, and subscriptions. Outstanding refunds remain claimable after closure. We retain personal information only as described in our Privacy Policy and required or permitted by applicable law.
Closing an account does not eliminate a valid unpaid obligation or a claim that arose before closure. It does not automatically forfeit refundable paid entitlements.
12. Restrictions, Termination, and Appeals
We may issue a warning, remove content, limit a feature, temporarily suspend access, or terminate an agreement for a serious or repeated breach. Measures will be proportionate and based on reasonable grounds.
We will explain the reasons, relevant rules, scope, duration, and appeal method before taking action where practicable. Immediate action may be necessary to address account theft, fraud, unlawful conduct, or an urgent security threat, followed by prompt notice. Where a breach can reasonably be remedied, we will allow a reasonable opportunity to do so before termination.
An investigative suspension must be necessary, supported by objective grounds, and limited in scope and duration. We will explain material delays. If the action was mistaken or a violation is not established, we will restore access and provide an appropriate extension, refund, or other remedy for affected paid access.
You may appeal through support within 30 days after notice, or later where there is a justified reason. We will respond within 15 days of receiving an appeal or explain why more time is needed and give an expected response date. These internal periods do not restrict legal remedies.
13. Responsibility and Liability
Each party is responsible under applicable law for loss caused by its own breach or wrongful conduct. Where both parties contributed to a loss, their respective responsibility will be considered.
Liability for events beyond our reasonable control or circumstances attributable solely to you may be limited only to the extent permitted by law. We take reasonable steps to reduce harm.
We do not guarantee that every device or external service will be compatible or that use will produce a particular personal, creative, or financial result. This does not remove our obligations concerning expressly promised features, quality, or mandatory warranties and remedies.
Free access, guest use, device changes, application deletion, or the involvement of a third party do not automatically exclude our responsibility. Nothing excludes or limits liability for intentional misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited.
14. Changes to These Terms
We may update these Terms for changes in law or the Services. We will describe the changes, reasons, and effective date at least seven days in advance. Material or disadvantageous changes will be announced at least 30 days in advance and individually notified where required.
We will obtain express consent where legally required or where a change materially and adversely alters important rights or obligations under an existing agreement. Silence or continued use alone will not be treated as acceptance of such a change.
If you do not accept a change, you may terminate and request settlement of unused paid entitlements under Section 7. Existing terms continue to govern an existing agreement unless validly changed. If objective and reasonable grounds prevent us from continuing under those conditions, we may end the affected agreement after at least 30 days’ individual notice and appropriate settlement.
15. Notices and Support
We may communicate by the email address you provide, in-app notices, or another agreed electronic channel. Important notices will be accessible for review and retention. General announcements may be posted for at least seven days, but do not replace individual notice where required.
For guest use without contact details, we use available in-app means while observing any applicable notice and consent requirements. Contact support using Section 18 for complaints, refund requests, content reports, or appeals.
16. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Korea. Mandatory protections and jurisdictional rights applicable to consumers in other countries remain unaffected.
We will seek to resolve disputes in good faith. You may use competent consumer or content dispute resolution bodies and courts under applicable law. These Terms do not impose mandatory arbitration or a blanket exclusive court jurisdiction on consumers.
17. General Provisions
If a provision is invalid or unenforceable, the remaining provisions continue to the extent they can achieve their purpose. Operating rules may explain how these Terms are implemented but may not override important rights or mandatory law.
This English text is a contractual version of these Terms. No unpublished Korean document overrides it. If we provide another language version, we will explain any applicable language rule before acceptance, without reducing mandatory rights or defeating reasonable reliance on the version presented to you.
Privacy Policy
1. Who We Are
Hellotoon, Inc (“Hellotoon,” “we,” “us,” or “our”) provides mobile applications and related services that link to this Privacy Policy (the “Services”). This Policy covers personal information processed through those Services, including their in-app purchases and advertising.
You can contact us about privacy at hellotoonapps@gmail.com. Our address and privacy contact details appear in Section 13.
This Policy explains our processing practices and your choices. It is not blanket consent to collect information. Where separate consent or additional notice is required, we provide it before the relevant processing.
2. Information We Process
Customer support
If you contact us, we receive the email address or other contact details you use, the contents of your message, and any attachments or transaction details you choose to provide. We use this information to answer your request, investigate problems, process applicable refunds, and handle complaints. Please avoid sending sensitive information unrelated to your request.
In-app purchases
Purchases are processed through the marketplace or payment provider shown at checkout. That provider processes payment information under its own privacy notice. Information received by Hellotoon or its integrated software is specified below; the provider’s independent collection is not automatically collection by Hellotoon.
Advertising and technical information
Our Services display advertisements. Advertising software can process information directly, even where Hellotoon does not receive a separate copy. The specific providers and their actual processing must therefore be included in this Policy.
The following table identifies the information processed through our purchase and advertising integrations, including relevant device and technical information:
Any separate analytics, account, upload, sensitive-information, or other processing used by a covered Service must be described in an applicable service-specific privacy notice before it begins. We do not obtain authority for undisclosed processing merely by describing general categories in this Policy.
3. Advertising Choices and Device Controls
We obtain consent or platform authorization before tracking, personalized advertising, or other processing where required by applicable law or platform rules. Refusing optional consent does not prevent access to unrelated basic features
Non-personalized advertising may still involve technical information for delivery, security, frequency control, or measurement. The actual information and purposes are stated in Section 2. Changing a device setting does not automatically delete information already collected; you may request deletion under Section 9.
If we send marketing communications, we do so only where legally permitted and with consent where required. You may opt out using the message or the available controls. Necessary support, transaction, and security messages are distinct from marketing.
4. Service Providers and Disclosures
The following organizations process information on our behalf or receive information for their own purposes. A provider’s role depends on the relevant service and configuration, not simply its name.
We require providers acting on our behalf to protect information, restrict it to authorized purposes, and comply with applicable confidentiality and security obligations. We oversee entrusted processing as required by law. Independent recipients may also have their own notices, without removing our responsibilities for a disclosure.
We may disclose information when legally required, in response to a valid legal request, or under another applicable legal ground where necessary to protect rights or safety. We assess the request and limit disclosure to what is legally justified.
If a business transfer changes the organization responsible for information, we provide the notices and choices required by law. A transfer does not permit unrestricted processing for unrelated purposes.
5. International Transfers
Overseas storage, processing, and remote access, where they occur, are described below. The headquarters of a provider does not by itself identify where information is processed.
Use of the Services is not blanket consent to international transfers. We obtain separate consent where required. If a different legal ground applies, we provide the notices and safeguards required for that ground. Contact us for information about applicable safeguards and rights.
6. Retention and Destruction
Ordinary retention periods and deletion triggers are listed in Sections 2, 4, and 5. We delete information when the relevant purpose is fulfilled and it is no longer lawfully needed.
Records retained by law are restricted to the relevant purpose. Preservation for an existing claim or valid legal requirement is limited to the necessary information and period; it is not a reason to retain all information indefinitely.
When deletion is due, we identify and remove the information from active processing. Electronic records are erased using methods designed to prevent reconstruction, and any paper records are securely destroyed.
7. How to Request Deletion
To request deletion of information held by Hellotoon, email hellotoonapps@gmail.com. Identify the application involved and provide enough information to locate your request or transaction, without sending unnecessary sensitive information. We may request proportionate identity verification and will explain any information that must be retained by law.
Where platform rules require both an in-app initiation route and an external web route, those routes will be provided.
Uninstalling an application does not necessarily delete information held by us or a provider, and does not necessarily cancel a marketplace subscription. Requests concerning information independently held by a marketplace or another independent provider can also be directed to that organization under its own privacy notice. This does not remove our duties concerning information for which we are responsible.
8. Security
We implement appropriate organizational and technical safeguards based on the nature and risk of the processing. These include restricting access, protecting confidential information, securing network transmission, and applying safeguards to providers processing information for us.
No system can be guaranteed completely secure. This does not limit our duty to protect information. If a personal information incident occurs, we take the containment, investigation, notification, and reporting steps required by applicable law.
9. Your Rights
Subject to applicable law, you may request access, correction, deletion, restriction or suspension of processing, withdrawal of consent, objection to processing, or a portable copy or transfer of eligible information. A legal representative or authorized agent may act for you where permitted.
Send requests to hellotoonapps@gmail.com. We request only information reasonably needed to verify identity or authority, respond within the applicable legal timeframe, and explain any lawful refusal or extension and the available review options.
Withdrawal of consent does not affect processing lawfully completed before withdrawal. Where information is necessary for a requested service or a legal obligation, withdrawal or deletion may affect that particular service or be subject to limited retention. We explain the effect and do not require unrelated information as a condition of basic access.
You may complain to the competent privacy authority in your jurisdiction. Our Terms of Service and internal procedures do not restrict mandatory privacy rights.
10. Children’s Privacy
The intended audience and child-access policy for the covered Services are: {{ACTUAL_AUDIENCE_AND_CHILD_ACCESS_POLICY}}.
Where parental or guardian consent is legally required, we obtain and verify it before the relevant processing. In Korea, this includes processing based on consent for children under 14. Other jurisdictions may impose additional requirements.
The applicable age and consent safeguards are: {{ACTUAL_AGE_AND_PARENTAL_CONSENT_SAFEGUARDS}}.
If you believe information about a child has been collected without required authorization, contact hellotoonapps@gmail.com. We investigate and delete, restrict, or otherwise address the information as required. An app-store age rating alone does not replace legally required child-privacy measures.
11. Other Processing and Local Requirements
Our actual use of personal information for significant automated decisions, AI model training, or pseudonymized research is: {{ACTUAL_OTHER_PROCESSING_OR_NONE}}. Applicable explanations, legal grounds, safeguards, and rights must be provided before such processing begins. Advertising profiling, if used, is described in Sections 2 and 3.
Additional local disclosures, representatives, and rights required for the territories where the Services are offered are identified at: {{LOCAL_PRIVACY_NOTICE_OR_NOT_APPLICABLE}}.
12. Changes to This Policy
We update this Policy when relevant practices or legal requirements change and revise the effective date. We provide notice of material changes as required by law. Where new consent is required, we obtain it before beginning the affected processing.
Previous versions and their effective dates are available at {{POLICY_VERSION_HISTORY_URL}}.
